Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Yaarikut website at https://www.yaarikut.com/ and any associated mobile or progressive web applications (collectively, "Yaarikut", the "Service" or the "Website"), operated by Yaarikut. By accessing, registering for, or using the Service, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Account Registration & Eligibility

1.1. Age requirement: You must be at least 18 years old to register or use Yaarikut. By creating an account you represent that you are 18+ and have the legal capacity to enter these Terms. We do not knowingly collect data from anyone under 18.

1.2. Account information: You agree to provide accurate, current, and complete information during registration and to keep it up to date. You may register with an email address or via supported third-party providers (currently Google and Facebook).

1.3. Account security: You are responsible for safeguarding your password and access tokens, and for all activity under your account. Notify us at support@yaarikut.com immediately of any unauthorized access. We are not liable for losses caused by your failure to protect your credentials.

1.4. One account per person: You may not maintain multiple accounts or impersonate another person.

2. The Service

Yaarikut is a social-network service that allows registered users to: create a profile, post text status updates, photos, videos and blog articles; like, comment, share and report content; send private chat messages; live-stream video and chat in real time; follow other users; view aggregated news and live TV channels; and discover places near them. Some features (chats, blog publishing, livestreaming) may be subject to plan limits which we may change from time to time.

3. User Content & License Grant

3.1. Your content stays yours: You retain all ownership rights in the photos, videos, posts, blogs, comments, chat messages, livestream recordings, profile information and any other material you submit ("User Content").

3.2. Licence to operate the service: By submitting User Content, you grant Yaarikut a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, modify (for example resizing/transcoding), publicly display, publicly perform, distribute and create derivative works of that content, solely to the extent necessary to operate, promote and improve the Service. This licence ends when you delete the content or your account, except (a) where the content has been shared with other users who have not deleted their copy, and (b) for backup retention periods described in the Privacy Policy.

3.3. Your warranties: You warrant that you own or have the necessary rights to all User Content you submit, that it does not infringe any third party's intellectual property, privacy, publicity or other rights, and that publication on Yaarikut does not violate any law.

4. Prohibited Conduct

You agree not to:

• Violate any law, regulation or third-party right;
• Post, stream, or transmit content that is unlawful, hateful, threatening, harassing, defamatory, fraudulent, obscene, pornographic, or sexually explicit, that sexualises or endangers minors, or that promotes discrimination, violence or terrorism;
• Impersonate any person or misrepresent your affiliation with any person or entity;
• Upload viruses, malware, or any code designed to disrupt the Service;
• Scrape, crawl, mirror, harvest, or otherwise extract data from the Service without our prior written consent;
• Reverse-engineer, decompile or attempt to derive the source code of the Service except as permitted by applicable law;
• Use the Service to send spam, chain messages, pyramid schemes, or unsolicited commercial communications;
• Circumvent any access controls, rate limits, or plan-tier restrictions;
• Use bots or automated means to register accounts, post content, like, follow or interact;
• Live-stream copyrighted material you do not have the right to broadcast.

5. Reporting & Moderation

We provide in-product reporting tools to flag posts, comments or user accounts. We may, but are not obliged to, review reports and take action including removing content, restricting features, or suspending or terminating accounts. We may also act on our own initiative if we determine, at our sole discretion, that content or conduct violates these Terms.

6. Subscriptions, Payments & Refunds

6.1. Plans: Some features require a paid subscription (e.g., Pro, Premium). Pricing, features and billing periods are shown on the pricing page before checkout.

6.2. Payment processors: Payments are processed by third-party providers, currently PayPal and Cashfree, depending on your region. We do not store your full payment card details — those are handled by the processor under its own terms and PCI-DSS controls.

6.3. Recurring billing: If you purchase a recurring subscription, you authorise us (via the processor) to charge your payment method automatically at the start of each billing period until you cancel.

6.4. Cancellation: You may cancel any time from the Subscription page. Cancellation stops future renewals; access to paid features continues until the end of the current billing period.

6.5. Refunds: Except where required by applicable consumer protection law, fees are non-refundable. Disputes about charges must be raised with us within 30 days at support@yaarikut.com. See our full Refund & Cancellation Policy.

6.6. Taxes: Prices are exclusive of any applicable taxes (e.g., GST, VAT) unless otherwise stated.

7. Live Streaming & Camera / Microphone Access

To broadcast a live stream you must grant your browser permission to access your camera and microphone. You confirm that you have the right to broadcast everyone and everything visible and audible in the stream and that no participant is under 18 without verifiable parental consent. We may interrupt or remove streams that we believe violate these Terms or applicable law.

8. Referral Program

If we offer a referral program, you may earn rewards (such as additional chats, blog credits or external-link allowances) when a friend signs up using your referral code. Rewards are at our discretion and may be modified or revoked if we detect abuse, fraudulent sign-ups, or duplicate accounts.

9. Intellectual Property Rights of Yaarikut

The Yaarikut name, logo, layout, design, source code, page structure and any content provided by us (excluding User Content) are owned by Yaarikut or its licensors and are protected by Indian and international copyright, trademark and other intellectual property laws. You receive a limited, revocable, non-transferable, non-exclusive licence to access and use the Service for personal, non-commercial use in accordance with these Terms.

10. Copyright Complaints (DMCA / IT Rules)

If you believe content on Yaarikut infringes your copyright, send a notice to support@yaarikut.com containing: (i) your contact details and electronic signature; (ii) identification of the copyrighted work; (iii) the exact URL of the allegedly infringing material; (iv) a statement made in good faith that the use is not authorised; and (v) a statement under penalty of perjury that the information is accurate and you are authorised to act on the rights holder's behalf. We respond to valid notices in line with the U.S. DMCA (17 U.S.C. § 512) and the Information Technology (Intermediary Guidelines) Rules, 2021 (India).

11. Third-Party Services

Yaarikut integrates third-party services to deliver functionality: Google Sign-In, Firebase Authentication, Facebook Login, Google AdSense (advertising), Google Maps & Places API (places near you), Mixpanel (product analytics), Google Analytics (traffic analytics), PayPal (payments), and external sources for news content. Use of those features is subject to the providers' own terms and privacy policies. We are not responsible for third-party content or links from our Service to external sites.

12. Advertising

The Service is partially supported by advertising delivered through Google AdSense. By using the Service you acknowledge that Google and its partners may serve interest-based ads using cookies and similar technologies as described in our Privacy Policy.

13. Termination & Account Deletion

13.1. You may stop using Yaarikut at any time. You can delete your account from the Settings page or by emailing support@yaarikut.com. We will delete or anonymise your personal data within the timeframes described in the Privacy Policy, except where retention is required for legal, accounting, security or fraud-prevention reasons.

13.2. We may suspend or terminate your account, with or without notice, if you breach these Terms, if continued provision becomes impractical or unlawful, or for any other reason at our discretion. On termination, the licence in Clause 3 survives only to the extent necessary to maintain copies of your content already shared with other users.

14. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted operation. We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

15. Limitation of Liability

To the maximum extent permitted by law, Yaarikut, its directors, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages — including loss of profits, data, goodwill or other intangible losses — arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. Our aggregate liability for any direct damages shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to liability or (b) INR 1,000.

16. Indemnity

You agree to indemnify, defend and hold harmless Yaarikut and its affiliates from any claims, damages, liabilities, losses, costs and expenses (including reasonable legal fees) arising from (i) your use of the Service, (ii) your User Content, (iii) your violation of these Terms, or (iv) your violation of any rights of a third party.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. If you are a consumer resident in the European Economic Area, the United Kingdom or Switzerland, you also have the right to bring proceedings in your country of residence.

18. Changes to These Terms

We may modify these Terms from time to time. Material changes will be notified through an in-product banner or by email to your registered address at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms; we may assign them to any successor or affiliate. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Yaarikut regarding the Service.
